Terms and Conditions
Welcome to Cascadia Marquee! These terms and conditions outline the rules and regulations for the use of our website and services. By accessing or using Cascadia Marquee, you agree to comply with these terms. If you do not agree, please refrain from using our services.
1. Definitions

- "Deliverables" refer to the work product, including but not limited to websites, code, designs, and technical solutions created by Cascadia Marquee.
- "Services" refer to web development, design, technical assistance, and other digital services provided by Cascadia Marquee.
2. Services Provided
Cascadia Marquee provides digital and web development services to clients. Our services include but are not limited to:
- Website design, development, and optimization
- Custom web application development
- Technical assistance and troubleshooting
- Low-code and no-code automated system creation
- JavaScript, TypeScript, PHP, and other programming solutions
- Content management system implementation (Webflow, WordPress, Shopify)
- Website optimization for speed and ADA compliance
- Hosting and domain management services
3. User Accounts
To access certain features or services, you may be required to create an account. By registering, you agree to:
- Provide accurate and complete information.
- Maintain the security of your account credentials.
- Be responsible for all activities occurring under your account.
We reserve the right to suspend or terminate accounts found in violation of these terms.
4. Client and Contractor Responsibilities
For Cascadia Marquee (Contractor):
- Provide services in a professional and timely manner
- Communicate regularly about project progress
- Deliver work products as specified in project agreements
- Provide support for deliverables as outlined in specific agreements
- Comply with all applicable laws and regulations
For Clients:
- Provide necessary materials, content, and feedback in a timely manner
- Review work and be reasonably available for questions
- Comply with payment terms as outlined in invoices and agreements
- Ensure that client-supplied materials do not infringe on intellectual property rights
- Use services and deliverables in compliance with applicable laws
5. Payments and Fees
Cascadia Marquee charges fees for services rendered. By engaging our services, you agree to:
- Pay any applicable fees in a timely manner according to the payment schedule
- Acknowledge that fees are non-refundable unless otherwise stated
- Pay invoices within 15 days of receipt
- Accept that late payments may incur a late fee of 10% per month on outstanding amounts
- Allow us to update our fee structure with prior notice
6. Intellectual Property
Work Product Ownership
Unless otherwise specified in a separate agreement, all content, deliverables, and work product created by Cascadia Marquee for clients become the property of the client upon payment in full.
Cascadia Marquee Portfolio Rights
Clients grant Cascadia Marquee permission to use completed work as part of portfolios, websites, and galleries to showcase our work, provided such use is not for commercial purposes beyond promotion of our services.
Background IP
Cascadia Marquee may use intellectual property it owns or has licensed from third parties in the course of providing services. This background IP remains the property of Cascadia Marquee or its licensors, but clients receive a non-exclusive license to use such background IP as part of the delivered work product.
Website Content
All content, trademarks, and intellectual property on the Cascadia Marquee website belong to us or our licensors. You may not copy, distribute, or use our website content without permission.
7. Prohibited Activities
Users must not:
- Engage in fraudulent, deceptive, or illegal activities
- Infringe on intellectual property rights
- Attempt to disrupt or compromise our services
- Use our services to distribute malicious software or content
- Reverse engineer any software provided by Cascadia Marquee
Violating these rules may result in termination of services or legal action.
8. Limitation of Liability
Cascadia Marquee provides services "as is" without warranties of any kind, except as explicitly stated in separate agreements. We are not responsible for:
- Damages that could not reasonably have been foreseen
- Business losses incurred by users beyond direct damages
- Technical issues beyond our control
- Third-party services integrated with our deliverables
- Misuse of deliverables after acceptance
Our total liability for any claims is limited to the amount paid for the specific services related to the claim.
9. Confidential Information
Both parties agree to treat confidential information with the same degree of care they would use to protect their own confidential information. Confidential information includes business strategies, client lists, unpublished code, and other proprietary information. This obligation continues even after our services conclude.
The receiving party may only use confidential information to perform obligations under these terms and will not disclose it to third parties without written permission.
10. Independent Contractor Relationship
Cascadia Marquee operates as an independent contractor, not as an employee, partner, or agent of the client. This means:
- We use our own equipment, tools, and materials to perform services
- We determine when, where, and how work is carried out
- We cannot enter into contracts or make promises on behalf of clients
- We are responsible for our own taxes and benefits
- No employer-employee relationship is created through these terms
11. Term and Termination
Either party may terminate services with 7 days' written notice. Upon termination, clients will pay for all services rendered up to the termination date.
Certain obligations survive termination, including intellectual property rights, confidentiality requirements, limitation of liability, and payment obligations for services rendered.
12. Modifications to Terms
We may update these terms from time to time. Continued use of our services after updates constitutes acceptance of the revised terms.
